These Terms & Conditions outline the rules and regulations for the use of the C2 Mobile Application (“App”), owned and operated by Curoil N.V. and its affiliated companies (“CUROIL Group”).
By accessing, downloading, registering for or using the App, you accept these Terms & Conditions in full. If you disagree with any part of these Terms & Conditions, you must not use the App.
All terms refer to the use of the App and the services provided through the App in accordance with and subject to the laws of Curaçao.
1 Definitions
In these Terms:
- User / You / Your: means any person using the App and compliant with the Company’s terms and conditions.
- The Company, Ourselves, We, Our and Us: means the CUROIL Group.
- Account: means the registered user profile created in the App.
- Party, Parties or Us: means to both the User and ourselves.
- Services: means all functionalities offered through the App, including fuel card services and account management.
- Fuel Card: means prepaid or postpaid fuel payment instruments linked to the App.
2 Registration and Account
Certain functionalities of the App may require registration and the creation of a user account.
You warrant and represent that:
- All information provided by you is accurate, complete and up to date;
- You are authorized to use the payment methods, fuel cards and accounts linked to your profile;
- You are responsible for maintaining the confidentiality of your login credentials;
- You are fully responsible for all activities performed under your Account;
- You will immediately notify CUROIL Group of any unauthorized access to or use of your account.
CUROIL Group reserves the right to suspend or terminate accounts that are suspected of fraudulent, unlawful, unauthorized use or breached these Terms.
3 C2 Services
The App provides users with access to certain services offered by the CUROIL Group, including but not limited to:
- Prepaid fuel card services;
- Postpaid fuel card services;
- Fuel card management;
- Balance inquiries;
- Transaction history;
- Account management;
- Station locator services;
- Other services that may be made available from time to time.
CUROIL Group reserves the right to modify, suspend, discontinue, or restrict any service available through the App at any time without prior notice.
4 Relationship with other Agreements
The App is provided as a platform through which Users may access and manage products and services offered by the CUROIL Group.
The use of the App does not replace, amend, supersede, or terminate any separate agreement between the User and the CUROIL Group, including but not limited to prepaid fuel card agreements, postpaid customer agreements, credit agreements, fleet card agreements, or other applicable terms and conditions.
Where a product or service accessed through the App is subject to separate terms and conditions, such terms and conditions shall continue to apply and shall prevail in the event of any inconsistency with these Terms & Conditions.
Nothing in these Terms & Conditions shall be construed as modifying any payment obligations, credit arrangements, liability provisions, or other contractual obligations arising under any separate agreement between the User and the CUROIL Group.
5 Prepaid Services
Users of prepaid services acknowledge and agree that:
- No minimum balance may be required, subject to any limits imposed by CUROIL Group;
- A maximum balance may apply as determined by CUROIL Group from time to time;
- Balances may not be transferred to another account, card, or user unless expressly authorized by CUROIL Group;
- Users are solely responsible for safeguarding their prepaid balances and account credentials;
- Prepaid accounts that remain inactive for a continuous period of five (5) years or more may be deactivated and any remaining balance may be forfeited, subject to applicable law.
6 Postpaid Services
Users of postpaid services acknowledge and agree that the use of postpaid services remains subject to the applicable customer agreement, fuel card agreement, credit agreement, or other contractual arrangement entered into with the CUROIL Group.
All charges incurred remain payable in accordance with such agreements and applicable payment terms.
Failure to make timely payment may result in suspension or termination of services and any other remedies available to the CUROIL Group under the applicable agreement or law.
CUROIL Group reserves the right to impose credit limits and other account restrictions in accordance with the applicable customer agreement.
7 Transactions
All transactions made through the App are deemed authorized by the Account holder.
Users are responsible for verifying the accuracy of all transaction details before confirmation.
Transaction records maintained by CUROIL Group shall constitute prima facie evidence of the relevant transaction unless proven otherwise.
CUROIL Group reserves the right to reject, delay, reverse or suspend transactions where required for operational, security, regulatory, fraud-prevention purposes or Legal or regulatory compliance.
8 Lost, stolen or compromised Accounts
If a mobile device, fuel card, password, authentication code or any other access credential is lost, stolen or compromised, the User must immediately notify CUROIL Group.
CUROIL Group shall not be liable for any fraud, misuse, unauthorized transaction or loss occurring prior to receipt of such notification.
9 Acceptable Use
Users agree not to:
- Use the App for any unlawful purpose;
- Interfere with or disrupt the operation of the App;
- Attempt to gain unauthorized access to systems, networks, or data;
- Upload or transmit viruses, malware, or malicious code;
- Use the App in a manner that may damage the reputation, services, or interests of the CUROIL Group.
10 Intellectual Property
All intellectual property rights in the App, including all material, content, software, trademarks, logos, graphics and information contained in the App, are owned by CUROIL Group or its licensors. All intellectual property rights are reserved.
You may access and use the App for your personal or authorized business use, subject to the restrictions set forth in these Terms & Conditions.
Users are not allowed to:
- Republish material from the App;
- Sell, rent, or sub-license material from the App;
- Reproduce, duplicate or copy material from the App;
- Use CUROIL Group branding without permission;
- Redistribute content from the App without prior written consent.
11 Availability of the App
We do not guarantee uninterrupted availability of the App.
The App may be unavailable due to, including but not limited to:
- Scheduled maintenance;
- System upgrades;
- Technical failures;
- Telecommunications interruptions;
- Events beyond the reasonable control of CUROIL Group.
12 Privacy and Data protection
Your use of the App is subject to our Privacy Policy.
By using the App, you acknowledge and agree that we may collect, use, storage and process your personal data including but not limited to:
- Account and identification data;
- Transaction data;
- Device and usage information;
- Security and fraud prevention data.
All processing is carried out in accordance with applicable data protection laws and our Privacy Policy.
13 Reservation of rights
CUROIL Group reserves the right to:
- Suspend, restrict or terminate access to the App;
- Refuse transactions were permitted by law;
- Block transactions;
- Monitor usage of the App for security and operational purposes;
- Amend these Terms & Conditions at any time.
By continuing to use the App following any amendment, you agree to be bound by the revised Terms & Conditions.
14 Disclaimer
To the maximum extent permitted by law, the App and all services provided through the App are provided on an “as is” and “as available” basis.
CUROIL Group does not warrant that:
- The App will always be available or uninterrupted;
- The App will be free from defects, errors, viruses or security vulnerabilities;
- Information displayed in the App will always be complete, accurate or up to date.
Nothing in this disclaimer shall limit or exclude any liability that may not be limited or excluded under applicable law.
15 Limitation of Liability
To the maximum extent permitted by law, CUROIL Group shall not be liable for any direct, indirect, incidental, consequential, special, exemplary or punitive damages arising from or related to:
- The use of or inability to use the App;
- Unauthorized access to accounts;
- Loss, theft, misuse, or compromise of credentials;
- Transaction errors or delays;
- Service interruptions or technical failures;
- Loss of data, profits, revenue, business opportunities or goodwill.
16 Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Curaçao.
Any dispute arising out of or in connection with these Terms & Conditions or the use of the App shall be subject to the exclusive jurisdiction of the competent courts of Curaçao.
